 1) Introduction and Contact Details of the Controller

1.1 We are pleased that you are visiting our website and thank you for your interest. In the following, we inform you about the handling of your personal data when using our website. Personal data are all data with which you can be personally identified. 

1.2 The controller responsible for data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is Tami Vrcon Caldano dr.dent.med. 2) Data Collection When Visiting Our Website

2.1 When using our website purely for information purposes, i.e. if you do not register or otherwise transmit information to us, we only collect data that your browser transmits to our server (so-called “server log files”). When you access our website, we collect the following data that is technically necessary to display the website to you:

  • The website visited
  • Date and time of access
  • Amount of data sent in bytes
  • Source/reference from which you came to the page
  • Browser used
  • Operating system used
  • IP address used (possibly in anonymized form)

The processing is carried out in accordance with Art. 6(1)(f) GDPR on the basis of our legitimate interest in improving the stability and functionality of our website. The data is not passed on or used in any other way. However, we reserve the right to check the server log files retrospectively if there are concrete indications of illegal use.

2.2 This website uses SSL or TLS encryption for security reasons and to protect the transmission of personal data and other confidential content (e.g. orders or inquiries to the controller). You can recognize an encrypted connection by the string “https://” and the lock symbol in your browser bar.

3) Hosting & Content Delivery Network

For the hosting of our website and the display of page content, we use a provider who provides its services either itself or through selected sub-contractors exclusively on servers within the European Union. All data collected on our website is processed on these servers. We have concluded a data processing agreement with the provider that ensures the protection of our visitors’ data and prohibits unauthorized disclosure to third parties.

4) Cookies

To make visiting our website attractive and to enable the use of certain functions, we use cookies, i.e. small text files that are stored on your terminal device. Some of these cookies are automatically deleted when the browser is closed (so-called “session cookies”), while others remain on your terminal device for longer and allow the storage of page settings (so-called “persistent cookies”). In the latter case, you can find the storage duration in the overview of your web browser’s cookie settings. Insofar as individual cookies used by us also process personal data, the processing is carried out in accordance with Art. 6(1)(b) GDPR for the performance of the contract, in accordance with Art. 6(1)(a) GDPR in the case of consent given, or in accordance with Art. 6(1)(f) GDPR to safeguard our legitimate interests in the best possible functionality of the website as well as a customer-friendly and effective design of the visit. You can set your browser so that you are informed about the setting of cookies and decide individually whether to accept them or to exclude the acceptance of cookies for certain cases or in general. Please note that if cookies are not accepted, the functionality of our website may be restricted.

5) Contact

In the context of contacting us (e.g. via contact form or email), personal data is collected. Which data is collected in the case of using a contact form can be seen from the respective contact form. This data is stored and used exclusively for the purpose of answering your request or for contacting you and the associated technical administration. The legal basis for the processing of this data is our legitimate interest in answering your request in accordance with Art. 6(1)(f) GDPR. If your contact is aimed at concluding a contract, an additional legal basis for the processing is Art. 6(1)(b) GDPR. Your data will be deleted after final processing of your request. This is the case when it can be inferred from the circumstances that the matter in question has been conclusively clarified and provided that no statutory retention obligations prevent deletion.

6) Web Analysis Services

Google Analytics 4 

This website uses Google Analytics 4, a web analytics service provided by Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”), which enables an analysis of your use of our website. By default, Google Analytics 4 sets cookies when you visit the website, which are stored as small text files on your terminal device and collect certain information. This information also includes your IP address, which is shortened by Google by the last digits to exclude direct personal identifiability. The information is transmitted to Google servers and further processed there. Transfers to Google LLC in the USA are also possible. Google uses the information collected on our behalf to evaluate your use of the website, compile reports on website activity for us, and provide other services related to website use and internet use. The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data. The data collected as part of the use of Google Analytics 4 is stored for a period of two months and then deleted. All of the aforementioned processing operations, in particular the setting of cookies on the terminal device used, only take place if you have given us your express consent in accordance with Art. 6(1)(a) GDPR. Without your consent, Google Analytics 4 will not be used during your visit to the site. You can revoke your consent at any time with effect for the future. Demographic Characteristics Google Analytics 4 uses the special “demographic characteristics” function and can use it to create statistics that make statements about the age, gender and interests of visitors to the site. This is done through the analysis of advertising and information from third-party providers. This allows target groups for marketing activities to be identified. However, the collected data cannot be assigned to a specific person and is deleted after storage for a period of two months.

Google Signals As an extension to Google Analytics 4, Google Signals can be used on this website to create cross-device reports. If you have activated personalized ads and linked your devices to your Google account, Google can, subject to your consent to the use of Google Analytics in accordance with Art. 6(1)(a) GDPR, analyze your usage behavior across devices and create database models, including cross-device conversions. We receive no personal data from Google, only statistics. If you wish to stop cross-device analysis, you can deactivate the “Personalized advertising” function in your Google account settings. UserIDs As an extension to Google Analytics 4, the “UserIDs” function can be used on this website. If you have consented to the use of Google Analytics 4 in accordance with Art. 6(1)(a) GDPR, have set up an account on this website and log in to this account on different devices, your activities, including conversions, can be analyzed across devices.

7) Page Functionalities

7.1 YouTube This website uses plugins to display and play videos from the following provider: Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland Data may also be transmitted to: Google LLC, USA When you access a page on our website that contains such a plugin, your browser establishes a direct connection to the provider’s servers to load the content, at the latest when the video is played. Certain information, including your IP address, is transmitted to the provider. When embedded videos are played via the plugin, the provider also sets cookies to collect information about user behavior, create playback statistics and prevent abusive behavior. If you are logged into a user account with the provider during your visit to the site, your data will be directly assigned to your account when you click on a video. If you do not wish your data to be assigned to your account, you must log out before activating the playback button. All of the aforementioned processing operations, in particular the setting of cookies to read information from the terminal device used, only take place if you have given us your express consent in accordance with Art. 6(1)(a) GDPR. 7.2 Google Maps This website uses an online map service from the following provider: Google Maps (API) from Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”). Google Maps is a web service for displaying interactive (land) maps to visually present geographical information. By using this service, our location is displayed to you and any journey is facilitated. Even when calling up the subpages into which the Google Maps map is integrated, information about your use of our website (such as your IP address) is transmitted to Google servers and stored there; this may also involve transmission to Google LLC servers in the USA. This takes place regardless of whether Google provides a user account through which you are logged in or whether a user account exists. If you are logged in to Google, your data will be directly assigned to your account. If you do not wish your data to be assigned to your Google profile, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates them. The collection, storage and evaluation are carried out in accordance with Art. 6(1)(f) GDPR on the basis of Google’s legitimate interest in displaying personalized advertising, market research and/or the needs-based design of Google websites. You have the right to object to the creation of these user profiles, which you must exercise by contacting Google. If you do not agree to the future transmission of your data to Google in connection with the use of Google Maps, you also have the option of completely deactivating the Google Maps web service by disabling JavaScript in your browser. Google Maps and thus the map display on this website can then no longer be used. Insofar as legally required, we have obtained your consent to the processing of your data as described above in accordance with Art. 6(1)(a) GDPR. 7.3 Google Web Fonts This page uses so-called web fonts from the following provider for the uniform display of fonts: Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland When a page is called up, your browser loads the required web fonts into its browser cache in order to display texts and fonts correctly and establishes a direct connection to the provider’s servers. Certain browser information, including your IP address, is transmitted to the provider. 7.4 Google reCAPTCHA On this website, we use the CAPTCHA service of the following provider: Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland Data may also be transmitted to: Google LLC, USA. For the visual design of the CAPTCHA window, the provider uses “Google Fonts”, i.e. fonts loaded from Google over the internet. No processing of information other than the above, which is already transmitted to Google via the reCAPTCHA functionality, takes place in this regard. The service checks whether an entry is made by a natural person or abusively by machine and automated processing, and blocks spam, DDoS attacks and similar automated malicious access. To ensure that an action is performed by a human and not by an automated bot, the provider collects the IP address of the terminal device used, recognition data of the browser and operating system type used, as well as date and duration of the visit, and transmits this to the provider’s servers for evaluation. Cookies may be used in this process, i.e. small text files stored in the browser of the terminal device. Insofar as the aforementioned processing operations are based on cookies, these are only set if you have given us your express consent in accordance with Art. 6(1)(a) GDPR. You can revoke your consent at any time with effect for the future by deactivating this service in the “Cookie Consent Tool” provided on the website. If the aforementioned processing operations are carried out without the use of cookies, the legal basis is our legitimate interest in establishing individual responsibility on the Internet and preventing abuse and spam in accordance with Art. 6(1)(f) GDPR. We have concluded a data processing agreement with the provider, which ensures the protection of our visitors’ data and prohibits unauthorized disclosure to third parties. 8) Tools and Miscellaneous

Cookie Consent Tool This website uses a so-called “Cookie Consent Tool” to obtain effective user consent for cookies and cookie-based applications requiring consent. The “Cookie Consent Tool” is displayed to users when the page is called up in the form of an interactive user interface in which consent can be given for certain cookies and/or cookie-based applications by ticking boxes. In this way, only those cookies and/or cookie-based applications for which the respective user has given consent are loaded by using the tool. This ensures that such cookies are only placed on the terminal device of the respective user if consent has been given. The tool sets technically necessary cookies to store your cookie preferences. Personal user data is generally not processed in this process. If personal data (such as the IP address) is processed in individual cases for the purpose of storing, assigning or logging cookie settings, this is done in accordance with Art. 6(1)(f) GDPR on the basis of our legitimate interest in legally compliant, user-specific and user-friendly consent management for cookies and thus in a legally compliant design of our website. Further legal basis for the processing is furthermore Art. 6(1)(c) GDPR. As the controller, we are subject to the legal obligation to make the use of technically non-essential cookies dependent on the respective user consent. Insofar as required, we have concluded a data processing agreement with the provider that ensures the protection of our visitors’ data and prohibits unauthorized disclosure to third parties. 9) Rights of the Data Subject

9.1 The applicable data protection law grants you the following data subject rights (rights of access and intervention) vis-à-vis the controller with regard to the processing of your personal data, whereby reference is made to the stated legal basis for the respective exercise requirements:

  • Right of access pursuant to Art. 15 GDPR;
  • Right to rectification pursuant to Art. 16 GDPR;
  • Right to erasure pursuant to Art. 17 GDPR;
  • Right to restriction of processing pursuant to Art. 18 GDPR;
  • Right to information pursuant to Art. 19 GDPR;
  • Right to data portability pursuant to Art. 20 GDPR;
  • Right to revoke consents granted pursuant to Art. 7(3) GDPR;
  • Right to lodge a complaint pursuant to Art. 77 GDPR.

9.2 RIGHT TO OBJECT IF WE PROCESS YOUR PERSONAL DATA WITHIN THE FRAMEWORK OF A BALANCING OF INTERESTS ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THIS PROCESSING WITH EFFECT FOR THE FUTURE ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION. IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE AFFECTED DATA. FURTHER PROCESSING IS RESERVED, HOWEVER, IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR IF THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENSE OF LEGAL CLAIMS. IF YOUR PERSONAL DATA IS PROCESSED BY US FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING. YOU CAN EXERCISE THE OBJECTION AS DESCRIBED ABOVE. IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE AFFECTED DATA FOR DIRECT MARKETING PURPOSES.

9.3 RIGHT TO LODGE A COMPLAINT WITH THE SUPERVISORY AUTHORITY You have the right to lodge a complaint with a supervisory authority at any time, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of personal data relating to you infringes the GDPR. 10) Duration of Storage of Personal Data 

The duration of storage of personal data is determined by the respective legal basis, the processing purpose and – if applicable – additionally by the respective statutory retention period (e.g. commercial and tax retention periods). In the case of processing of personal data on the basis of express consent pursuant to Art. 6(1)(a) GDPR, the data concerned will be stored until you revoke your consent. If there are statutory retention periods for data processed in the context of legal or quasi-legal obligations on the basis of Art. 6(1)(b) GDPR, these data will be routinely deleted after expiry of the retention periods, provided that they are no longer required for contract fulfillment or contract initiation and/or there is no legitimate interest on our part in further storage. In the case of processing of personal data on the basis of Art. 6(1)(f) GDPR, this data is stored until you exercise your right to object pursuant to Art. 21(1) GDPR, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims. If personal data is processed for the purpose of direct marketing on the basis of Art. 6(1)(f) GDPR, this data will be stored until you exercise your right to object pursuant to Art. 21(2) GDPR. Unless otherwise stated in the other information in this declaration about specific processing situations, stored personal data will otherwise be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.

11) Processing of Personal Data in the Dental Practice (in Particular Health Data)

In our dental practice, we process personal data, in particular special categories of personal data (health data) within the meaning of Art. 9(1) GDPR, insofar as this is necessary for the performance of dental treatment, billing and related administrative tasks. The processed data includes in particular:

  • Master data (name, address, date of birth, insurance number, contact details),
  • Health data (anamnesis, findings, diagnoses, treatment plans, X-ray images, treatment progress, laboratory results),
  • Billing data (services, fees, insurance affiliation).

The purposes of processing are medical diagnostics, treatment, counseling, prevention, billing with health insurance companies and private patients as well as the fulfillment of statutory documentation and retention obligations.

Legal bases:

  • Art. 9(2)(h) GDPR in conjunction with § 22(1) No. 1 lit. b BDSG (processing for purposes of health care, medical diagnostics, care or treatment),
  • Art. 6(1)(b) GDPR (fulfillment of a contract or pre-contractual measures),
  • Art. 6(1)(c) GDPR (fulfillment of legal obligations, e.g. retention obligations),
  • Art. 6(1)(f) GDPR (legitimate interest, e.g. quality assurance, defense against liability claims).

Recipients or categories of recipients:

  • Health insurance companies and statutory health insurance dental associations (KZVB),
  • Billing offices,
  • Dental laboratories (insofar as necessary for the production of dental prostheses),
  • External service providers such as our practice software provider Dampsoft GmbH (Ergodent / DS-Win), with whom a data processing agreement pursuant to Art. 28 GDPR has been concluded (server location in Germany/EU),
  • Authorities (e.g. in the case of statutory reporting obligations).

The data is retained for at least 10 years after completion of treatment (§ 630f BGB, GoBD, § 28(4) RöV for X-ray documents). Deletion then takes place unless other retention obligations or legitimate interests prevent this. We implement technical and organizational measures in accordance with the state of the art and the KZVB IT Security Guideline to protect your data.

12) Data Protection Officer 

We have not appointed a data protection officer, as the requirements of Art. 37 GDPR in conjunction with § 38 BDSG are not met in our single practice (in particular, no large-scale automated processing of personal data by at least 20 persons).
